1. Acceptance of Terms

By accessing or using the Avengers Booster Club website ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use this Site. These Terms apply to all visitors, registered users, and persons who purchase products or services through the Site.

2. About the Organization

The Avengers Booster Club is a volunteer-run parent booster organization supporting East Greenwich High School student-athletes in East Greenwich, Rhode Island. This Site is operated independently and is not an official website of East Greenwich High School, the East Greenwich School Department, or any governmental entity. All content is provided by Booster Club volunteers.

The Avengers Booster Club is organized as a nonprofit organization under Rhode Island law. Any reference to tax-deductibility should be independently verified with your tax advisor, as we make no representation regarding our current 501(c)(3) status.

3. Eligibility

You must be at least 18 years of age to create an account or make a purchase on this Site. By registering, you represent that you are 18 years of age or older. Scholarship and banquet registration forms may be completed by a parent or guardian on behalf of a student.

4. Payments & Payment Processing

All payments on this Site are processed by Square, Inc., a third-party payment processor. When you initiate a purchase, you will be redirected to Square's secure, hosted checkout page. The Avengers Booster Club does not collect, store, or have access to your payment card number, CVV, card expiration date, or any other cardholder data. All cardholder data is entered directly on Square's servers and is subject to Square's Terms of Service and Privacy Policy.

By completing a purchase, you agree to Square's Terms of Service available at squareup.com/us/en/legal/general/ua. Prices are listed in U.S. Dollars (USD). We reserve the right to correct pricing errors.

5. Booster Passes

• Booster passes are digital and valid for admission to home athletic events at East Greenwich High School only, unless otherwise specified.
• Passes must be presented on a mobile device or printed in a scannable format at the gate.
• Each pass contains a unique QR code and is non-transferable — one admission per scan per event.
• Passes are valid for the season year indicated on the pass and expire at the end of that season.
• Lost or inaccessible passes may be reissued upon verification of purchase. Contact us at Egavengerspass@gmail.com.
• The Booster Club reserves the right to revoke a pass without refund in cases of misuse, fraud, or violation of school or event rules.
• Passes do not guarantee admission if an event is cancelled, postponed, moved off-site, or reaches venue capacity as determined by the school. No refund is issued for cancelled or postponed events unless the Booster Club determines otherwise at its sole discretion.
• Booster passes are separate from and do not replace any admission fees charged directly by East Greenwich High School or visiting schools for special events, playoffs, or RIIL/state-sanctioned events.

6. Refunds & Cancellations

Please review our full Refund Policy before making a purchase. A summary:

• Booster Passes: All sales are final. No refunds except in cases of duplicate charges or verified technical errors. Refund requests must be submitted within 7 days of purchase.
• Event Tickets: Refunds may be requested up to 48 hours before the event start time. No refunds after that time.
• Donations: Donations are voluntary and non-refundable.
• Apparel: Apparel orders are fulfilled by a third-party vendor (Printify). Returns and exchanges are governed by the vendor's return policy.

7. Donations

All donations are voluntary. No goods or services are provided in exchange for donations unless otherwise explicitly stated at the time of donation. Donation amounts are non-refundable. Tax-deductibility of donations should be confirmed with your tax professional.

8. Apparel & Third-Party Store

Apparel products displayed on this Site are sold through a third-party storefront (Printify). By clicking "Shop Now" or any apparel link, you will be leaving this Site and entering a third-party website governed by that vendor's terms, privacy policy, and return policy. The Avengers Booster Club is not responsible for transactions, product quality, delivery, or customer service related to third-party apparel sales.

9. Scholarship Applications

Scholarship applications are subject to the eligibility criteria and selection process determined by the Booster Club's board of directors. The Booster Club's decisions regarding scholarship awards are final. Submission of an application does not guarantee an award. Application materials will not be returned.

10. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

11. User-Submitted Content

By submitting content (scholarship essays, photos, registration information), you grant the Avengers Booster Club a non-exclusive, royalty-free license to use that content solely for the purposes of operating our programs. We will not use photos of minors in public marketing without express parental consent.

12. Intellectual Property

All content on this Site — including logos, text, graphics, and design — is owned by or licensed to the Avengers Booster Club. You may not reproduce, distribute, or create derivative works without our express written permission.

13. Third-Party Links

This Site contains links to third-party websites (Square, Printify, SignupGenius, social media, etc.). These links are provided for convenience only. We do not endorse and are not responsible for the content, privacy practices, or terms of any third-party site.

14. Disclaimer of Warranties

THIS SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE AVENGERS BOOSTER CLUB, ITS OFFICERS, DIRECTORS, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR PURCHASE OF ANY PRODUCT OR SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless the Avengers Booster Club and its volunteers from any claims, losses, or damages (including legal fees) arising from your violation of these Terms or misuse of this Site.

17. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Rhode Island, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Providence County, Rhode Island. You waive any objection to jurisdiction or venue in such courts.

18. Changes to These Terms

We reserve the right to update these Terms at any time. The "Effective Date" at the top of this page reflects the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.
